Facts
Mary Koveleskie (plaintiff) worked for SBC Capital Markets, Inc. (SBC) (defendant) as a securities trader. Koveleskie’s job required her to register as a securities representative with several securities exchanges. To register, Koveleskie signed the exchanges’ Form U-4 registration form, which required arbitration of all disputes, including employment disputes, between exchange members such as SBC and registered representatives such as Koveleskie. After resigning from SBC, Koveleskie filed a charge with the Equal Employment Opportunity Commission, received a right-to-sue letter, and filed an action against SBC in district court for employment-related sexual discrimination claims under Title VII of the Civil Rights Act of 1964 (Title VII). SBC requested a motion to compel arbitration, which the district court denied. SBC appealed.
