Facts
Horst Kraus (plaintiff) and his wife lived in Barrington Hills, Illinois (defendant). Out of their home, Kraus and his wife operated an organization called The Happy Medium Unlimited, which was an association of heterosexual couples who engaged in consensual sexual activities with one another. Barrington Hills officials attempted to stop Kraus from operating the organization. Barrington Hills zoning officials wrote to Kraus for violating a local zoning code. Barrington Hills also had its police officers surveil Kraus’s home and instructed officers to ticket individuals who went to Kraus’s home. The officers also noted the license-plate numbers of cars that went to the Kraus home. In response to the officers’ activities, Kraus sued Barrington Hills. Kraus claimed that Barrington Hills violated his First Amendment rights of association and sought injunctive relief and damages. Barrington Hills moved to dismiss the complaint.
