Facts
Adolph and Rose Kresha were married and co-owners of two tracts of land. Adolph, without Rose’s knowledge, leased the property they were not living on to their son, Joseph (defendant). Rose (plaintiff) then filed for divorce and was awarded the land in the divorce settlement. Rose told Joseph that she was terminating the lease, but he refused to vacate so she brought this action to obtain possession.
