Facts
Charles Hall (plaintiff) suffered from acquired immune deficiency syndrome (AIDS) and was physically deteriorating when he requested that his physician, Dr. McIver (plaintiff), help him commit suicide to end his suffering. Hall and McIver sought a declaratory judgment that a state statute that prohibited assisted suicide violated the United States Constitution and the privacy clause of the Florida Constitution. Hall and McIver also sought an injunction against the state attorney (defendant) to prevent the prosecution of McIver if he gave deliberate assistance to Hall to help him end his life. The trial court granted the requested relief after finding that Hall was mentally competent, suffering as a result of the terminal illness, and in clearly deteriorating health. The state attorney then appealed.
