Facts
Nasser Ameri (plaintiff) was a regular patron at the Discovery Club, a nightclub owned by Kristie’s Katering, Inc. (Kristie’s) (defendant). On July 21, 1996, Ameri arrived at the nightclub around 1:00 a.m. Ameri’s friend got into a verbal confrontation with another man, and Ameri tried to separate them. Shortly thereafter, the nightclub started to close. As Ameri was leaving with his friend, a security guard, Lamont Charleston, grabbed Ameri from behind and choked him while another security guard punched and broke his nose. Ameri’s medical bills related to the incident were $6,300. According to Ameri, six weeks before the incident he had a dispute with Charleston in the parking lot during which Charleston told him, “I will get you.” Security guards frequently ejected disruptive patrons from the nightclub, but Kristie’s had no formal training program, training manuals, or rules or regulations governing security-guard conduct at the nightclub. Ameri sued Kristie’s for negligent training or supervision. A jury returned a verdict in Ameri’s favor, and the trial court denied Kristie’s motion for judgment notwithstanding the verdict. Kristie’s appealed.
