Facts
Hull (defendant) was an employee of Kubik, Inc. (Kubik) (plaintiff). Kubik sold hydrostatic drive units that were used in factory systems. Kubik’s cutting-edge model was called the Kubik Hydradrive, of which Kubik sold a total of 22. Hull gave confidential engineering information to one of Kubik’s competitors. Kubik sued Hull, alleging trade-secret misappropriation and unfair competition. The trial court entered a judgment in favor of Kubik and entered an injunction against Hull. The injunction permanently enjoined Hull from making, using, or selling the technology at issue. Hull appealed, arguing that the trial court’s remedy was too broad.
