Facts
The University of Nebraska annually sold eight season tickets to Nebraska football games to William Goldman (defendant). Goldman kept four season tickets for himself and had an ongoing agreement with Robert Kully (plaintiff) to sell four to Kully. Kully filed suit, seeking an injunction declaring Goldman trustee of Kully’s four tickets for the benefit of Kully’s use. The district court ruled in favor of Kully, granting specific performance of the requested trust. Goldman appealed.
