Facts
The county public defender’s office (OPD) (plaintiff) brought an injunctive class action against Luzerne County (defendant), arguing that its inadequate funding and staffing violated indigent defendants’ right to counsel. The trial court dismissed the complaint for failure to state a cognizable cause of action, and the appellate court affirmed. The OPD appealed to the state supreme court, arguing that the extremely limited representation its funding allowed amounted to constructive denial of counsel.
