Facts
Joseph Kurpiel (plaintiff) conveyed the subject property to his then-wife Jenny Kurpiel and their son Edward Kurpiel (defendants). An attorney drafted the deed, which conveyed the property to “Joseph Kurpiel, Jenny Kurpiel and Edward Kurpiel all residing [at the subject property], jointly and not as tenants in common.” Joseph filed an action for partition of the property.
