Facts
The state (plaintiff) charged L.O.W. (defendant) with a delinquency petition in Arapahoe County District Court. The state alleged that, had L.O.W. been an adult, the state would have charged L.O.W. with second-degree burglary. The record showed that during a detention hearing, the evidence disclosed L.O.W.’s previous juvenile record. The juvenile court had adjudicated L.O.W. as a delinquent child in two prior cases and had reserved ruling on L.O.W. in another case. L.O.W. had previously failed to appear for a jury trial and revocation hearing in Arapahoe County and a court appearance in Jefferson County. At the time of the detention hearing, L.O.W. was on probation for carrying a concealed weapon. The district court found that probable cause existed to detain L.O.W. at the Arapahoe Youth Center before trial. The district court denied L.O.W.’s request for bond. L.O.W. appealed.
