United States Court of Appeals for the Sixth Circuit
83 F.4th 460 (2023)

- Written by Sean Carroll, JD
Facts
Kentucky and Tennessee (defendants) passed laws prohibiting the use of puberty blockers, hormone-replacement therapy, and sex-transition surgery in minors with gender dysphoria. A few transgender children and their parents (collectively, the advocates) (plaintiffs) sued the states, alleging that the laws violated their due-process and equal-protection rights under the United States Constitution. The district court granted preliminary injunctions, enjoining the states from enforcing the laws. The states appealed, and the United States Court of Appeals for the Sixth Circuit consolidated the cases.
