La Marra v. Adam
Pennsylvania Supreme Court
164 Pa.Super. 268, 63 A.2d 497 (1949)
- Written by Eric Miller, JD
Facts
Around 1:00 a.m., a police car ran a red light at 45 miles per hour while carrying a prematurely born baby to the hospital. The police car collided with a civilian car that had the green light. The police car was not sounding a siren at the time of the accident. Parties in both vehicles sustained injuries. The civilians (plaintiffs) sued the police officers (defendants) and the city (defendant). The trial court found in favor of the civilians. The police appealed. The Pennsylvania Supreme Court granted certiorari.
