Facts
Thunder Labastida died at only seven weeks old. His father severely beat and abused Thunder over the course of many weeks, leaving conspicuous bruises and bite marks over 50 to 75 percent of his body. The prosecution (plaintiff) charged Thunder’s mother, Kriseya Labastida (defendant), with murder and child neglect for failing to prevent the fatal abuse. The jury convicted Labastida of second-degree murder. Labastida appealed.
