Facts
During the trial of a dispute between Ladd (plaintiff) and Marshall (defendant), Marshall’s wife testified at trial. After the trial was concluded, Marshall’s wife claimed that she had testified falsely in court at the behest of her husband because her husband had coerced her to lie, though clear evidence of actual coercion was lacking. On the basis of this claim, Ladd petitioned the England and Wales Court of Appeal for a new trial.
