Facts
Siegel (defendant) planned to build and operate a public garage and gas station in Philadelphia. Siegel’s neighbors (plaintiffs) filed a lawsuit, alleging that the construction and operation of a gas station and garage would constitute a public nuisance. The trial court granted an injunction prohibiting the proposed use. Later, Siegel developed a more limited plan to use the property to rent out parking spaces to nearby apartment buildings. Siegel petitioned the trial court to modify the injunction in order to permit the more limited use. The trial court granted the request and entered a modified injunction. The neighbors appealed.
