Facts
New Dominion, LLC, Spess Oil Company, and several unknown entities (collectively, the operators) (defendants) operated wastewater-injection wells and other wells in central Oklahoma. In November 2011, Sandra Ladra (plaintiff) was in her home in central Oklahoma when a magnitude 5.0 earthquake struck nearby. During the earthquake, rocks fell onto Ladra from her fireplace and chimney, injuring Ladra’s knees and legs. Ladra brought a personal-injury action seeking damages from the operators in Lincoln County District Court, asserting that the operators’ injection wells had caused the earthquake and therefore had proximately caused Ladra’s injuries. The district court dismissed Ladra’s action after concluding that the Oklahoma Corporation Commission (OCC), a state regulatory body, had exclusive jurisdiction over cases involving oil-and-gas operations in the state. Ladra sought review of the district court’s order in the Oklahoma Supreme Court.
