Facts

Laker Airways Ltd. (plaintiff) was a British airline carrier that provided low-cost transatlantic flights between the United States and Europe. Pan American World Airways, TWA, McDonnell Douglas Corporation, and McDonnell Douglas Finance Corporation (the American conspirators) (defendants) were American airline companies. British Airways and British Caledonia Airways (the British conspirators) (defendants) were British airline carriers. Swissair, Lufthansa, KLM, and Sabena (the European conspirators) (defendants) were non-British airline carriers that operated flights between the United States and Europe. Laker Airways filed suit alleging that the American, British, and European conspirators, all of whom had business operations in the United States, plotted to ruin its business through meetings held partly in Florida, in violation of American antitrust laws. Some of the conspirators had previously filed actions against Laker Airways in Britain, where American antitrust laws did not apply, to try to prevent Laker Airways from filing its lawsuit in the United States. Laker Airways motioned for partial summary judgment on the issue of whether the choice of forum was proper.
