Lamons Gasket Co. (defendant) voluntarily recognized a labor union (the union) as the exclusive representative of a unit of employees at a company facility based on the union’s showing that a majority of the employees at the facility signed union-authorization cards. Lamons Gasket posted a notice at the facility apprising employees of their right to seek a decertification election within 45 days. An employee (plaintiff) filed a timely decertification petition, supported by at least 30 percent of the employees in the unit. Lamons Gasket began collective bargaining with the union. Thereafter, the regional director of the National Labor Relations Board (the board) ordered an election. The union requested a review of the regional director’s decision, which the board granted. In the meantime, Lamons Gasket and the union reached a collective-bargaining agreement. The decertification election was held, and the ballots were impounded pending the board’s review.
