Facts
Municipality of Anchorage (defendant) police officers seized Steven Landers’s (plaintiff) personal property during a search of his home for marijuana plants. While the criminal litigation was pending, the municipality stored Landers’s personal property and eventually disposed of it without any notice to Landers. Included in the property were family photos and videotapes. Landers sued the municipality for his loss. The court ruled in his favor but excluded any evidence of the property’s special value to Landers. Consequently, the jury returned a damage award lower than the amount the municipality had originally offered to Landers. Landers appealed.
