Facts
David Lange (plaintiff), a former prime minister of New Zealand, brought a defamation action against the Australian Broadcasting Corporation (defendant). Australian Broadcasting argued that even assuming, for the sake of argument, that the alleged defamatory material against Lange was false, Australian Broadcasting was unaware of this, and that it published the material in a reasonable and not reckless matter. This was a traditional common-law defense to defamation actions.
