Facts
A hotel keeper (defendant) provided rat poison to a tenant who operated a coffee shop. The poison, which contained phosphorous, was placed near a burner in the coffee shop. This caused an explosion, which injured an employee (plaintiff) of the coffee shop. The employee brought suit against the hotel keeper. The employee alleged that, by furnishing the rat poison, the hotel keeper violated a statute that prohibited the laying of poison except in safe places in one’s own property. The purpose of the statute was to prevent people and animals from ingesting poison. The trial court found in favor of the hotel keeper. The employee appealed. The Oklahoma Supreme Court granted certiorari.
