Facts
Steven Jacobs was a former chief executive officer (CEO) of Las Vegas Sands Corporation (Sands). Jacobs was involved in litigation and sought to use documents of Sands that were protected by the attorney-client privilege. Sands’ current management asserted the privilege to prevent Jacobs from using the documents. The district court permitted Jacobs to use the documents, finding that Jacobs was entitled to access the documents as the former CEO of Sands. Sands filed a motion for a writ of prohibition to prevent Jacobs from using the documents.
