Facts
Laster (plaintiff) contracted mesothelioma after working at Celotex Corp. (defendant) for 41 years. Laster brought suit against Celotex, claiming that his exposure to and inhalation of asbestos while at work was the cause of his mesothelioma. Laster filed a pretrial motion asking the court to take judicial notice “of the fact that asbestosis is a disease which is caused by the inhalation of asbestos dust and fibers.” Celotex objects to the motion on the grounds that the language is too broad because it does not take into account the physical characteristics of the asbestos fiber or the length of exposure.
