Facts
Laura (plaintiff) purchased an interest in a parcel of real property with an outstanding mortgage balance. Christian (defendant) owned a one-quarter interest in the property. After Laura’s purchase, the cotenants made only one payment on the mortgage and the lender subsequently instituted a foreclosure suit. Laura paid the full balance of the mortgage to avoid foreclosure. Laura then initiated a quiet title action seeking to foreclose the interests of Christian and two other cotenants to the property. The district court quieted title in favor of Laura. Christian appealed.
