Facts
In 2000, the French Parliament enacted legislation granting the government of Corsica limited law-making powers. The legislation aimed to address to end 25 years of violence from separatists seeking independence for Corsica. The legislation provided the Assembly of Corsica the ability to formulate proposals to modify regulations on the competence, organization, and functioning of Corsican political institutions and regulations on the economic, social, and cultural development of Corsica. The legislation also provided that Corsica could request authorization from the French Parliament to adopt rules specific to the characteristics of Corsica after presenting the request to the French prime minister and the representative of the French state in Corsica. The legislation also provided that Corsica could propose changes to provisions passed by the French Parliament that were applicable to Corsica after presenting the request to the French prime minister and the representative of the French state in Corsica. The French Constitutional Council considered the constitutionality of Part IV of Article I 4424-2, a portion of the new law.
