Facts
In March 2020, at the beginning of the COVID-19 pandemic, the Kenyan government implemented emergency measures to stop the spread of the coronavirus. One of the measures was a nightly curfew from 7:00 p.m. to 5:00 a.m., issued in accordance with Kenyan Ministry of Health guidance that contact between people should be restricted. The Law Society of Kenya (LSK) (plaintiff) brought an action against Kenyan national officials, including Hillary Mutyambai (defendants), asserting that the curfew unconstitutionally restricted Kenyans’ fundamental freedoms.
