Facts
Holly loaned Fox (defendant) $300. Holly owed the same amount to Lawrence (plaintiff). Holly had promised to pay Lawrence the next day. Fox then promised to pay the $300 to Lawrence. When Fox did not pay Holly, Lawrence sued. Fox argued that that there was no proof that Holly was indebted to Lawrence, his agreement with Holly to pay Lawrence was void for lack of consideration, and there was no privity between the Fox and Lawrence. The jury found in favor of Lawrence, and Fox appealed.
