Facts
Universal Underwriters Insurance Company (Universal) (defendant) insured Norman Crutchfield under a standard policy that indemnified Crutchfield against all legal claims for unintentionally inflicted bodily injury. Frances Lazenby (plaintiff) successfully sued Crutchfield for the injuries Lazenby sustained in a car accident caused by Crutchfield’s reckless drunk driving. Universal covered the compensatory portion of the jury’s damages award for Lazenby but refused to cover the punitive portion of the award. Lazenby sued Universal to enforce indemnification. The trial court entered judgment for Lazenby. Universal appealed to the Tennessee Supreme Court.
