Facts
President Trump (defendant) issued an executive order reversing President Obama’s decision to withdraw certain coastal lands on the Outer Continental Shelf from oil and gas drilling and exploration. The oil industry immediately expressed interest in using seismic surveying to map the sea floor. Such surveys were allegedly harmful to sea life. The League of Conservation Voters (league) (plaintiff) sued, arguing that President Trump acted beyond his delegated powers enumerated in the Outer Continental Shelf Lands Act and the United States Constitution. President Trump argued that his decision was protected by sovereign immunity and that the league did not have standing to sue.
