Facts
Valerie Leahy (plaintiff) was driving on an unlit road on a dark night in a snowstorm. Leahy lost control of her car, and it got stuck in a snowbank on the opposite side of the road. Gary McClain (defendant) was driving on that opposite side of the road and did not see Leahy’s car until it was too late. The cars collided, and Leahy sustained injuries. Leahy sued McClain for negligence. At trial, Leahy sought to introduce photographs of the scene of the accident. The photographs were taken in daytime during dry conditions. The trial court sustained McClain’s objection to the introduction of the photographs, finding that their probative value was outweighed by their prejudicial effect. Leahy appealed.
