Facts
In an action in a New Jersey state court on an alleged debt between two Americans that was made in France and therefore presumptively governed by French law, the debtor moved for dismissal on the grounds that French law was neither pleaded nor proved. The trial court granted the debtor’s motion, and the appellate court affirmed. The creditor appealed.
