Facts
Joe Lee (defendant) was in a self-service pharmacy-liquor convenience store. A store employee saw Lee hide a bottle of cognac in his pants while holding another bottle in his hand. When the employee confronted Lee, he returned both bottles of cognac to the shelf and ran out of the store. The employee chased Lee and eventually flagged down a police cruiser. The police arrested Lee and charged him with theft. Lee was convicted and sentenced to one year in prison. Lee appealed his conviction to the Maryland Court of Special Appeals.
