Facts
P.M. Legler (defendant) agreed to transfer an oil lease to a Mr. Locke in exchange for $570. Locke testified that he gave Legler the money, and Legler agreed to deliver the lease to him the following day. Locke testified that he did not expect to get his money back but did expect to receive the lease. Legler did not hand over the lease or return Locke’s money. Legler was convicted of theft and appealed, arguing that the state did not show theft because Locke intended to part with both title and possession of his money.
