Facts
James and Ann Hayes (plaintiffs) had a 14-year-old son who worked in the coal mines for Lehigh & Wilkes-Barre Coal Co. (Lehigh) (defendant). The son was working in the mines when workers outside the mine began drawing coal from a coal chute. This action caused a pile of coal to fall on the Hayeses’ son, resulting in his death. The coal workers provided no warning to the son before drawing the coal chute, and at trial, this was determined to be customary practice. The trial court found in favor of the Hayeses, and Lehigh brought error.
