Facts
The City of Denver (the city) (the defendant) employed nurses. The city paid its nurses a wage that was consistent with the prevailing wage for nurses in the labor market. Nursing was a female-dominated occupation. Moreover, male-dominated occupations paid more than female-dominated occupations for comparable work. Hence, the prevailing wage for nurses in the labor market was a product of sex-based pay discrimination. A group of nurses (plaintiffs) employed by the city brought suit, contending that the city violated Title VII of the Civil Rights Act of 1964 (Title VII). The district court took the matter under advisement.
