Facts
The plaintiffs, residents of Massachusetts, were injured in a car accident that occurred in Rhode Island. In an action on that accident in a Massachusetts state court, the trial court applied Massachusetts law and instructed the jury that the defendant had the burden of showing the plaintiffs’ contributory negligence. The defendant appealed.
