Facts
Carolyn Lewis and others (plaintiffs) sued Ethicon, Inc. (defendant) for injuries allegedly sustained from their use of a pelvic mesh product designed by Ethicon to treat urinary incontinence. Lewis filed a motion in limine seeking to exclude statements from the American Urogynecologic Society (AUGS) in a recently published position statement. AUGS had stated that Ethicon’s product was the standard of care in the field and was safe and effective. Lewis claimed that the statements were inadmissible hearsay.
