Facts
Donald Lewis (plaintiff) and Annie Lewis (defendant) entered into a private separation agreement to be incorporated into their divorce decree. The agreement provided how the Lewises’ property was to be divided upon their divorce. The trial court reviewed the agreement and added a provision that Donald was to pay Annie an amount of $150 per month for three years. The trial court explained that the payment was necessary to offset Donald’s retirement income and provide a fair and equitable division of property. Donald appealed on the ground that the trial court improperly modified the Lewises’ private agreement by requiring Donald to provide Annie with future support payments.
