Facts
The council of the town of North Kingstown (defendant) authorized highway surveyor John Weeden (defendant) to raze a structure on a lot that the town considered to be part of a public highway. After the building was razed, its owners, John Lewis and others (defendants), brought a bill in equity to enjoin Weeden and the town from carrying out activities on the lot. Weeden and the town moved for dismissal, arguing that equitable relief was unavailable to the building owners because the building had already been razed.
