Facts
In the late 1990s, in response to a failing economy, Argentina (defendant) passed a number of regulations requiring the conversion of U.S.-dollar deposits to pesos and restricting investment transfers outside of Argentina. A foreign investor, LG&E Energy Corporation (LG&E) (plaintiff), instituted an arbitral case against Argentina, arguing that Argentina’s implementation of measures affecting foreign investments violated the U.S.-Argentine Bilateral Investment Treaty (BIT) and constituted an indirect expropriation of property.
