Facts
Widower Mary Bletcher executed a will leaving one-half of her property to her “sisters, Kate Bouquet and Sue Lovett,” and her “brothers, Frank Lichter and Emil Lichter.” The will left the residue and remainder of Mary’s property to Robert Bletcher, the nephew of Mary’s late husband. Emil and Kate predeceased Mary. After their deaths, Mary issued a codicil giving the proceeds of a property sale to the Lutheran Church. Upon Mary’s death, Robert argued that the bequests to Emil and Kate became part of the estate’s residue upon their respective deaths. Frank and Sue argued that Mary’s bequest to her siblings was a class gift. The trial court ruled in Robert’s favor. Frank and Sue appealed.
