Facts
Lightning Oil Company (Lightning) (plaintiff) and Anadarko E&P Onshore LLC (Anadarko) (defendant) owned adjacent mineral estates. Briscoe Ranch owned the surface estate overlying Lightning’s mineral estate. Anadarko received permission from Briscoe Ranch to site and drill a well on Briscoe Ranch’s surface land. Anadarko planned to drill through the subsurface to reach its own adjacent mineral estate. Lightning objected to Anadarko’s drilling of this well. Anadarko began drilling. Lightning brought suit against Anadarko for trespass, seeking to prevent Anadarko from further drilling. The trial court granted Anadarko’s motion for summary judgment. Lightning appealed.
