Linda R. v. Richard E.
New York Supreme Court, Appellate Division
162 A.D.2d 48 (1990)
- Written by Darius Dehghan, JD
Facts
Linda R. (plaintiff) and Richard E. (defendant) were married with twin daughters. Linda and Richard both worked outside the home, but Linda worked fewer hours than Richard. Linda filed for divorce and sought custody of the twins. Richard also sought custody. Although Linda had engaged in a sexual relationship with a lover after Linda and Richard decided to divorce, there was no evidence indicating that the relationship had harmed the twins. The trial court granted custody to Richard. Linda appealed.
