Facts
James Freed (defendant) was the city manager for Port Huron, Michigan. Freed had a Facebook account that he had opened prior to becoming a public official. Freed frequently posted on his account before and after his appointment to local government. Freed’s posts were primarily about his personal life, but he did post about things related to his official capacity as city manager. Freed began posting about COVID-19 during the pandemic. In response to Freed’s postings, Kevin Lindke (plaintiff) posted comments that were critical of the city’s response to the pandemic. Freed deleted the comments and ultimately blocked Lindke. Lindke sued Freed for violating his First Amendment rights. The United States Supreme Court granted certiorari.
