Facts
In 1926, Edward Lipps (plaintiff) executed a deed conveying to Margaret Howard a “one-half interest as joint tenant” in property Lipps owned. The deed also provided that Howard was to hold the property “as joint tenant” with Lipps and “not as tenant in common.” Howard died intestate. Denis Crowe (defendant), one of Howard’s heirs, claimed an interest in the property. Lipps brought an action to quiet title. Crowe asserted that Lipps and Howard were tenants in common, not joint tenants.
