Facts
On April 24, 2008, the German Bundestag adopted the Act Approving the Treaty of Lisbon. As a result, the Bundestag amended Article 23 of the Basic Law to permit the Bundestag and Bundesrat to bring legal action before the Court of Justice of the European Union if European Union legislation infringes upon the principle of subsidiarity. The German Federal Constitutional Court considered a consolidated set of cases, challenging Germany’s engagement in the Treaty of Lisbon.
