Facts
The Davenport Shooting Association (Association) (defendant) petitioned the Scott County Zoning and Planning Commission to rezone a tract of land in order to place a shooting range on it. The land in question, as well as the surrounding land, was originally zoned for agricultural use only. The Commission was divided evenly on the issue, and as a result, sent the decision to the Board of Supervisors, who approved the rezoning. The neighbors (plaintiffs) on the surrounding properties brought suit alleging that the rezoning was illegal spot zoning. The trial court agreed with the neighbors. The Association petitioned for certiorari to the Supreme Court of Iowa.
