Facts
The Livelys (plaintiffs) entered into a contract to purchase a home from the Garnicks (defendants). Once the home was built and the Livelys moved in, both parties discovered that the home had a leaky chimney, a flaw in the roof, and a broken air conditioner. The Livelys brought suit against the Garnicks for fraud and deceit. The court found in favor of the Livelys, and the Garnicks appealed.
