Facts
A fire at the MGM Grand Hotel in Las Vegas caused certain MGM employees (plaintiffs) to be unemployed for a period of time. The employees sued Stern and others involved in designing and building the hotel (defendants). Additionally, the employees’ unions sued the defendants to recover lost union dues for the same time period. The district court granted the defendants’ motion to dismiss. The plaintiffs appealed.
