Facts
German Lopez (defendant) was charged with attempted bribery of a federal agent. The agent, Roger Davis, recorded one of his conversations with Lopez, and the prosecution sought to admit the recording into evidence. Lopez filed a motion to suppress the recording. The lower court denied the motion. Lopez was convicted, and on appeal the First Circuit affirmed the conviction. The United States Supreme Court granted certiorari.
